Paradox Entertainment, which also has a strange origin story and history, claims to own the rights to some of the IP; what's been happening over the years is that producers simply pay off Paradox because the pay-off is cheaper then the cost of litigation. The actual copyright ownership of a lot of the old artwork is very, very obscure. Artists, back in the day, usually had to give up their rights to their artwork for a one-time payment and after that the magazine publisher owned the rights to the artwork. Most of those companies were pretty slipshod when it came to actual copyright filings (that cost money, after all!) and after they went out of business the legal trail got very murky and confused. Tracking down heirs is a long and messy process. Litigation is expensive, after all, and so there's a lot of confusion about who owns what.

Yes! "You are educated person!", to quote a Klingon I know... These two IPs are in an awesome mess, as the legal issues are murky at best. The old magazines were never all that great about keeping good records or doing copyright registrations, and the contracts with the authors and artists were also a mess. Sigh. It's why I keep my lawyer on retainer.
